1.In Game Currency Terms

These In-Game Currency Terms (these "In-Game Currency Terms") establish the terms and conditions between a customer (the "User") who uses the "ANOTHER EDEN" game (includes services ancillary to this application; the "Company Game") provided by [WFS, Inc.] (the "Company") on Steam ("Steam") managed and operated by Valve Corporation ("Valve") and the Company regarding the acquisition and use of virtual currency that can be used within the Company Game ("In-Game Currency").

The Company may amend these In Game Currency Terms at any time by posting the amended In Game Currency Terms on the Company Game. The amended In-Game Currency Terms will apply to all acquisition and use of In-Game Currency that occur on or after the date on which the amended In Game Currency Terms are posted, and if the User acquires or uses In-Game Currency after the amendment of these In Game Currency Terms, the User will be deemed to have agreed to the amended In Game Currency Terms.

The Company may discontinue the provision of all or some of the In-Game Currency due to reasons such as the amendment or repeal of a law or regulation or a change in social conditions. In such a case, the type of In-Game Currency that will no longer be provided and the refund method will be announced on the Company Game.

When acquiring and using In-Game Currency, the User shall comply with the WFS Terms of Use, Privacy Policy, other terms established by the Company (collectively, the "WFS Terms") and terms of use and privacy policy for Steam established by Valve (collectively, the "Steam Terms and Policy") in addition to these In Game Currency Terms. In the event of any discrepancy among the provisions of these In Game Currency Terms, the other WFS Terms and Steam Terms and Policy regarding the acquisition and use of In-Game Currency, these In Game Currency Terms shall prevail.

2. Acquisition of In-Game Currency

1. Account

The Company will set up one (1) account for the User for each unit of PC on which the User uses the Company Game ( "Device") and for a single Company Game ("Company Game Account"). If the same Company Game is used on a different Device, a different Company Game Account will be set up except for the case that User synchronizes the Digital Items (defined below) between different Devices pursuant to the manner as designated by Company. The Company will issue an Company Game Account to the User when the User installs the Company Game from Steam and starts up the Company Game. If the Company Game is reinstalled, a new Company Game Account will be issued. The Company will manage the User's acquisition or use of In-Game Currency for each Company Game Account. In-Game Currency may only be used by the actual User who holds an Company Game Account and shall not be transferred, assigned, exchanged for cash or other currency (including prepaid means of payment and other virtual currencies issued by a third party), or loaned to a third party other than the User, and the User shall not permit a third party to use the In-Game Currency. The User will manage the Company Game Account at his or her own responsibility and must ensure that third parties cannot access or use the Company Game Account. The Company may also restrict the quantity of In-Game Currency that the User can acquire at one time or hold in an Company Game Account. Even if the User acquires or holds multiple Company Game Accounts, In-Game Currency cannot be transferred between among each Company Game Account.

2.Free In-Game Currency

The Company may issue In-Game Currency to the User for free through the method specified by the Company (In-Game Currency issued for free shall be referred to as "Free In-Game Currency"). With regard to Free In-Game Currency, the qualifications for receiving the currency, the quantity of the currency to be issued, the acts for which the currency will be issued, and other issuance terms shall be as separately established by the Company. No refund will be provided for Free In-Game Currency, even in cases where the Company has discontinued the provision of all or some of the In-Game Currency.

3. Paid In-Game Currency

The User may purchase In-Game Currency by paying the amount displayed on the screen of the Company Game (In-Game Currency purchased for a fee shall be referred to as "Paid In-Game Currency").

4. Price of Paid In-Game Currency

The amount required for each purchase of Paid In-Game Currency will be displayed on the final purchase confirmation page displayed on the payment screen of the Company Game on the Device (including cases where it is a screen displayed by Valve.). The price of Paid In-Game Currency may change due to fluctuation in the exchange rate and other factors.

5. Payment

The User may settle a payment for Paid In-Game Currency via Steam Wallet electronic payment system provided by Valve, Steam Pre-paid card, credit card, or the like as designated by Valve (payment processing companies that make payments via credit card or the like shall be collectively referred to as "Outside Payment Vendor(s)"), provided that there may be cases where some payment methods cannot be used.

The Company shall not be liable for the selection and use of a payment method by the User. Any dispute regarding the payment method shall be resolved directly between Valve or the Outside Payment Vendor and the User.

The purchase of Paid In-Game Currency will be completed when the User clicks the purchase button on the final confirmation page for purchasing Paid In-Game Currency. Unless provided for in these In Game Currency Terms, after the completion of purchase, the purchase price of the Paid In-Game Currency will not be refunded. The Company will issue Paid In-Game Currency promptly after confirming the completion of the purchase of Paid In-Game Currency by the User, but the issuance of Paid In-Game Currency may be delayed in some cases due to the system and other reasons.

6. Taxes

The User will be responsible for all consumption taxes and other taxes and charges that apply to the acquisition, use, and license of In-Game Currency and digital content on the Company Game ("Digital Item(s)").

7. Purchase-related provisions

In cases where the Company Game cannot be used through no fault of the Company, the User will remain obligated to pay the purchase price of the Paid In-Game Currency under these In Game Currency Terms.

The purchase of Paid In-Game Currency and the use of Digital Items obtained with In-Game Currency will incur communication fees in addition to the purchase price of the Paid In-Game Currency.

If a minor will be purchasing Paid In-Game Currency, please be sure to obtain the prior consent of a guardian or a person with parental authority.

The acquisition or use of In-Game Currency may be suspended in some cases if the Company determines that it is necessary due to a system failure or for system maintenance inspection or other security management.

3.Use of In-Game Currency

1. Procedure

The User may acquire a license for the use of a Digital Item by exchanging (using) In-Game Currency through the method and within the range established by the Company. The Digital Item that will be licensed by the Company, the quantity of In-Game Currency required for such license, and other terms regarding the use of In-Game Currency will be individually determined for each Digital Item and will be displayed on the Company's website or the screen of the Company Game.

Paid In-Game Currency will be used after the Free In-Game Currency has been used, provided that if the purchase screen for items and the like states that Paid In-Game Currency will be consumed, Paid In-Game Currency will be used. The User may check the balance of the In-Game Currency in his or her possession through the procedure prescribed by the Company. If the User finds an error in the balance, he or she shall promptly notify the Company to that effect.

Unless prohibited by law or regulation, the Company may place restrictions on the quantity of In-Game Currency that can be exchanged for Digital Items within a certain period of time and other uses of In-Game Currency.

2. License for In-Game Currency and Digital Items

Even if terms such as "acquisition," "purchase," "buyback," "sale," or "order" are used in explanations relating to In-Game Currency and Digital Items, the User will merely acquire a license for the use of the In-Game Currency and Digital Items and will not acquire any ownership or other rights. Ownership and all other rights in the In-Game Currency and the Digital Items built into the Company Game will be retained by the Company. The use of In-Game Currency and Digital Items by the User will be limited to non-commercial, private use.

4.Expiration of In-Game Currency

Unless otherwise provided, there is no restriction on the period during which the Paid In-Game Currency can be used. Free In-Game Currency may have an expiration date where it can only be used for a certain period of time from the issuance date of the In-Game Currency (when the acquisition of Free In-Game Currency is recorded in the User's account). With regard to Free In-Game Currency, please check the expiration date in the terms and the like at the time the currency is acquired.

5.Prohibited Acts

1. Exchanges

Persons other than the User who acquired Paid In-Game Currency or Free In-Game Currency cannot use such In-Game Currency. In-Game Currency cannot be exchanged for anything other than the Digital Items designated by the Company. The Company may modify or alter the Digital Items at any time. Unless otherwise provided by law or regulation, the User is prohibited from exchanging Digital Items with a third party for money or anything with monetary value and anything that constitutes an economic benefit.

2. Refunds and transfers

Unless it is required by law or regulation or the Company determines that it is absolutely necessary, no refund or reissuance will be provided for In-Game Currency. If the Company is unable to confirm that the User requesting a refund or reissuance is the rightful holder of In-Game Currency, the Company may refuse to provide a refund or reissuance. The sale or assignment of In-Game Currency, exchange of In-Game Currency for cash, creation of a security interest in In-Game Currency, and the sharing of In-Game Currency with a third party are prohibited.

3. Other prohibited acts

The User shall not commit any act that infringes, or may infringe, the rights of the Company, Valve., Outside Payment Vendor, or any other third party or that interferes, or may interfere, with the Company Game or the Company's operation.

6.Suspension of Use or Cancellation by the Company

If the User does not pay the purchase price of Paid In-Game Currency or violates the WFS Terms, the Company determines that there is suspected fraud or improper or illegal activities in connection with the User's account, In-Game Currency, or Digital Items, or there is any other good cause, the Company may immediately take the following actions without notifying the User:

(a) Suspend or restrict access to the In-Game Currency in the User's account, and suspend the User's access to the Digital Items and the Company Game

(b) Suspend the use of or cancel some or all of the In-Game Currency or the account held by the User

Please note that, if the User receives a suspension of use or cancellation of his or her Company Game Account under this Section, the User will not be able to acquire or use any In-Game Currency and the purchase price of the In-Game Currency in his or her possession will not be refunded.

7.Termination by the User

If the User causes his or her Company Game Account and/or account for Steam to become invalid (e.g., voluntarily closes the account), even if there is a balance of In-Game Currency in the account, such balance will expire. In such a case, no termination or refund regarding the In-Game Currency will be granted.

8.Errors

When acquiring In-Game Currency, if an error occurs with regard to the price, explanation, order confirmation, order processing, issuance, or any other matter, the Company will fix such error and, if necessary, may fix the quantity of the acquired In-Game Currency (including charging the correct price) accordingly or cancel the acquisition of the In-Game Currency.

9.Limitation of Liability

EXCEPT IN THE CASE WHRE THE COMPANY IS AT FAULT, THE COMPANY OR ITS OFFICERS, EMPLOYEES, OR AGENTS SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING UNDER OR IN CONNECTION WITH THE ACUISITION, USE OR INABILITY TO USE IN GAME CURRENCY. IN NO EVENT SHALL THE COMPANY BE LIABLE UNDER ANY THEORY, FOR SPECIAL, INDIRECT, CONSEQUESTIAL, OR OTHER DAMAGES (INCLUDING, BUT NOT LIMITED TO, LOST PROFITS AND LOSS OF DATA), AND THE COMPANY'S LIABILITY SHALL NOT EXCEED THE AMOUNT THAT THE USER HAS PAID TO THE COMPANY AS CONSIDERATION FOR PAID IN-GAME CURRENCY.

10.Severability

If any provision of these In Game Currency Terms is determined to be in violation of a law or regulation or determined not to be legally binding on either party, such provision will be deemed invalid to the extent that it is determined to be in violation of such law or regulation or not to be legally binding, and all other provisions of these In Game Currency Terms will remain in full force and effect.
